In San Jose criminal defense news, prosecutor Ben Field has decided to leave the District Attorneys Office after a state bar judge suggested that the San Jose/Santa Clara County prosecutor be suspended for four years for ethical misconduct. All in all, this suggestion for suspension has it’s genesis in a California Bar Court Judge Pat McElroy recommendation, after the court found that Field had abused his prosecutorial powers in a criminal way and had committed misconduct in perhaps 4 or more criminal cases. According to a sixty-seven or so page ruling, the Judge in question said that the prosecutor was wrong because he went against the judge’s orders and withheld crucial evidence from the defense attorney which could have assisted their defense of their clients.
